Welcome to Dreamframer Art. These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Dreamframer Art (“we,” “us,” or “our”), operating as a Sole Proprietorship. These Terms govern your access to and use of our website and the purchase of our physical and digital products.

By accessing the site and placing an order, you agree that you have read, understood, and agreed to be bound by all of these Terms.

2. User Accounts & Security

You may be required to register with the site to track orders and manage your purchases. You agree to keep your password confidential and will be responsible for all use of your account and password. We explicitly reserve the right to remove, reclaim, suspend, terminate, or delete your user account at our sole discretion, at any time and for any reason, without notice or liability.

3. Age Restrictions & Minors

Our website is accessible to users of all ages. However, if you are a minor in your jurisdiction, you must have the permission of, and be directly supervised by, your parent or legal guardian to use the site and make purchases.

4. Digital Goods & Licensing

All digital files, including downloadable digital wall art, are strictly for personal use only. By purchasing a digital product, you are granted a limited, non-exclusive, non-transferable license to print the artwork for your personal enjoyment.

  • Prohibited Uses: You may not use the digital files for any commercial purpose. You are strictly prohibited from reselling, redistributing, sublicensing, or sharing the files.

  • Modifications: If you alter, edit, or modify the digital files in any way, you are still strictly prohibited from sharing, redistributing, or selling the modified versions. The underlying copyright remains entirely with Dreamframer Art.

5. Intellectual Property & Physical Products

All physical products sold by Dreamframer Art, including but not limited to mahjong tiles, mahjong mats, acoustical panels, and printed wall art, feature unique, proprietary designs.

  • Anti-Copying Clause: You are explicitly prohibited from reverse-engineering, tracing, copying, photographing for reproduction, or manufacturing replicas of our physical products, artwork, or designs. Competitors and customers alike may not use our physical products to create derivative works or attempt to source our designs for mass manufacturing or personal reproduction.

6. User-Generated Content

We may invite you to chat, contribute to, or participate in blogs, message boards, product reviews, and other functionality. You may also have the opportunity to upload photos of your mahjong setups, acoustical panel installations, or leave comments (collectively, “Contributions”).

  • Licensing Grant: By submitting Contributions to our site or social media channels, you grant Dreamframer Art a perpetual, non-exclusive, royalty-free, worldwide, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. This includes the right to repurpose your uploaded photos and reviews for our own marketing, advertising, and social media campaigns without compensation to you.

7. Governing Law

These Terms and your use of the website are governed by and construed in accordance with the laws of the State of South Dakota applicable to agreements made and to be entirely performed within the State of South Dakota, without regard to its conflict of law principles.

8. Dispute Resolution & Binding Arbitration

To best protect the business from protracted legal disputes and class action lawsuits, the following binding arbitration and class-action waiver clauses apply:

  • Binding Arbitration: Any legal controversy or legal claim arising out of or relating to these Terms or our services, excluding legal action taken by us to collect or recover damages for, or obtain any injunction relating to, website operations, intellectual property, and our services, shall be settled solely by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall take place in Sioux Falls, South Dakota.

     

  • Class Action Waiver: You and Dreamframer Art agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. Neither you nor Dreamframer Art will seek to have any dispute heard as a class action, a representative action, a collective action, or in any proceeding in which either party acts or proposes to act in a representative capacity.
